The original 9 was the result of negotiations with the DOC, after extensive 
consulting with the stakeholder community, as a condition which allowed 
ICANN to commence its experiment as NewCo.

It cannot be unilaterally rescinded. The argument given by the Study 
committee Report (that there is no sound logic to  half-of-the Board) is a 
non-argument.

The sound logic behind all structured checks and  balances is: to prevent 
brute majority power from  always beating sound and logical argument 
over  the head.

A structure where a predictable minority representing the demand-side 
interests sits only for decoration is ready to become a corrupt or abusive 
structure.
